THE MIDLAND CHIHUAHUA CLUB RULES
1. NAME AND OBJECTS: The Club shall be called THE MIDLAND CHIHUAHUA CLUB and its objects shall be to promote interest in and to encourage the breeding, exhibiting or owning of sound healthy Chihuahuas of correct type and Judging of them at shows according to the Official Standard of the Breed as laid down by The Kennel Club.
2. OFFICERS AND COMMITTEE: The Club shall consist of a president, Chairman, Vice Chairman, an unlimited number of Vice Presidents, Hon. Secretary, Hon. Treasurer, a Committee of up to fifteen all to be elected from the Membership and an unlimited number of members. The Committee shall have the power to co-opt as may seem necessary to maintain the strength of the Committee, but any co-opted person shall retire at the AGM and be eligible for election.
3. COMMITTEE & MANAGEMENT: The management of the Club shall be in the hands of a Committee consisting of elected members and the following Officers: President, Chairman, Vice Chairman, unlimited number of Vice Presidents, Hon. Secretary and Hon. Treasurer. A member should have been in the Club for one year before standing as a Committee member and three years before becoming an Officer (or being able to stand for an Officer of the Club). The Officers shall remain in office for three years, at the end of three years shall retire, but be eligible for re-election. The Committee shall retire annually, but be eligible for re-election. Any Officer or Member of the Committee who shall be absent from three consecutive meetings, without submitting reasonable excuse to the Committee, shall cease to hold office. The Chairman and or Committee shall hold meetings of the Committee as often as may seem necessary. Six shall form a quorum for the transaction of business. The Chairman of the Club shall be the Chairman of the Committee. No person whilst an undischarged bankrupt may serve on the Committee of, or hold any other office or appointment within a Kennel Club Registered Society.
4. ELECTION OF MEMBERS: Candidates for membership of the Club shall be proposed by one member, seconded by another, who shall sign the nomination form and such candidates must be approved by the Committee and subject to such approval, the candidate shall be admitted upon payment of a joining fee of £3.00 and the Annual Subscription, or the Life Membership Subscription.
4a. JUNIOR MEMBERS: A section be formed for Junior Members at a reduced membership fee and without rights from 5 to 16 years inclusive.
5. SUBSCRIPTIONS: The Annual Subscription shall be £5.00 single, £7.50 joint (2 persons at the same address) or £50.00 single, £75.00 joint (2 persons at the same address) Life Membership. The Committee to review these sums each year and discusses with the Hon. Treasurer whether any increase shall be necessary. All subscriptions shall be paid to the Hon Treasurer on or before the 1st January each year. No member whose subscription is unpaid shall be entitled to any of the privileges of membership and if any member shall fail to pay Annual Subscription by the 1st January each year the Committee have the power to erase his/her name from the list of Members, but if the Committee shall receive a satisfactory explanation the member may at the discretion of the Committee and upon payment of a re-joining fee of £3.00 and arrears, be re-admitted to Membership, without further proposal or nomination.
6. EXPULSION OF MEMBERS: Any member who shall be suspended under Kennel Club Rule A42j(4) and/or any member whose dog(s) is/are disqualified under Kennel Club Rule A42j(8) shall ‘ipso facto’ cease to be a member of the Club for the duration of the suspension and/or disqualification. If the conduct of any member shall, in the opinion of the Committee of the Club, be injurious or likely to be injurious to the character of the Club, the Committee of the Club may, at a meeting, the notice convening which includes as an object the consideration of the member, determine that a Special General Meeting of the Club shall be called for the purpose of passing a resolution to expel him/her. Notice of the Special General Meeting shall be sent to the accused member, giving particulars of the complaint and advising the place, date and hour of the meeting, that he/she may attend and offer an explanation. If at the meeting a resolution to expel is passed by two thirds majority of the members present and voting, his/her name shall forthwith be erased from the list of members and he/she shall thereupon cease for all purposes to be a member of the Club except that he/she may, within two calendar months from the date of such meeting appeal to The Kennel Club upon and subject to such conditions as The Kennel Club may impose.
7. THE FINANCIAL YEAR: The Financial year of the Society shall be from the 1st January to the 31st December.
8. ANNUAL GENERAL MEETING: The Annual General Meeting shall be held on any day, any time not later than the 30th April each year for the purpose:- to receive the Report of the Committee and the Balance Sheet. To elect Officers and Committee and to discuss any resolutions duly placed on the Agenda of which prior notice has been given to the Hon. Secretary. No business shall be transacted at an AGM unless notice thereof appears on the Agenda, with the exception of those, which in the opinion of the Chairman of the meeting are urgent. The election of Officers and Committee shall be by ballot of those members present at the Meeting. No members may vote/propose or seek election or serve on the Committee unless he/she has been a fully paid up member for at least 12 months. Independent Tellers shall be appointed to count the voting. Members shall receive 21 days’ notice of an AGM or SGM. A SGM may be summoned by the Committee, and the Secretary shall call a SGM if 20 members send a signed requisition stating they request a SGM and stating the subject to be discussed. No other business than the matter on the Agenda can be discussed at a SGM. The Committee shall decide the time and place of any such meeting, but the meeting shall take place within 8 weeks from receipt by the Secretary of requisition. The rules of the Society shall not be altered at a General or SGM. Notice of which to include details of the proposal to alter the rules. Any member desiring to bring notice of alteration or addition to the existing rules or any other business must give notice in writing to the Hon. Secretary not later than 28 days clear before an AGM. A majority vote shall be necessary to pass any such alteration. The Hon. Secretary in writing 7 days before an AGM must receive nominations for Officers and Committee, together with a written letter of acceptance by the nominee.
9. DISSOLUTION OF THE CLUB: In the event of the number of Annual members in the Club becoming less than 12 a SGM must be summoned by the Committee within 28 days, which SGM shall determine whether the Club should be dissolved.
10. DISSOLUTION OF THE CLUB (2): In the event of the Club being dissolved as a result of a resolution passed at any General Meeting the Committee shall thereupon or at such future date as shall be specified in such resolution, proceed to realise the property of the Club and after discharge of all liability shall divide the same equally among all annual and life members and upon completion of such division the Club shall be dissolved.
11. CLUB ACCOUNTS: A bank account shall be opened in the name of the Club into which all revenue of the club shall be paid and from which withdrawals shall only be made on the signature of two or more Officers. The Accounts shall be kept by the Hon. Treasurer. One qualified Accountant or two individuals with accountancy experience shall audit the society’s accounts. The Members shall receive a copy of the Balance Sheet upon attendance at the AGM.
12. MEMBERSHIP CARDS: The Midland Chihuahua Club shall have its own membership cards.
13. THE KENNEL CLUB: The Kennel Club Ltd shall be the final authority for interpreting the rules and regulations of the Club and in all cases related to canine or Club matters.
14. AFFILIATION: The Society shall not join any federation of Societies or Clubs.
15. JUDGING LISTS: A) The Midland Chihuahua Club shall have a judge’s sub-committee (consisting of members within the general committee that award Challenge Certificates in Longcoats and/or Smoothcoats, plus the Secretary). The judge’s sub-committee will be responsible for assessing judges, based on list criteria. They will allocate the appropriate classification i.e. Smoothcoat A3, B, C list and Longcoat A3, B, C list. The Kennel Club Ltd will be responsible for promoting, on the recommendation of the Club sub-committee and satisfactory assessment to the A2 list and subsequently A1 list.
B) Judges Lists will be reviewed annually by the Clubs Judges Sub-committee.
C) Judges will be appointed to Judge Club Shows from the A1, A2, A3, B and C lists by ballot through the sub-committee.
16. LIST OF MEMBERS: The list of members and their addresses shall be available for inspection if so required by the members of the Society.
17. MAINTENANCE OF TITLE: The Officers acknowledge that during the month of January each year Maintenance of Title fee will be forwarded to The Kennel Club by the Hon. Secretary for the continuance of registration and that by 31st July each year, other returns, as stipulated in Kennel Club regulations for the Registration and Maintenance Title of Societies and Breed Councils and the Affiliation of Agricultural Societies and Municipal Authorities, will be forwarded to The Kennel Club. The Officers also acknowledge their duty to inform The Kennel Club of any change of Secretary of the Society which may occur during the course of the year.
18. RESCUE, HEALTH AND WELFARE: The Club will raise funds during the accounting year on behalf of Chihuahua breed rescue and Chihuahua health and welfare. All funds collected will be divided and shared equally between the two issues.
19. SERVING COMMITTEE MEMBERS: The committee and officers of The Midland Chihuahua Club are only permitted to serve on one Chihuahua breed club at any one time.
20. OFFICERS OF THE CLUB DO NOT EXHIBIT OR HANDLE AT ANY OF OUR SHOWS.
